Promising confidentiality incorrectly

Section 16 of the POSH Act defines exactly what IC members may and may not disclose. Most IC members promise complete confidentiality - and then breach the Act in trying to keep that promise.

Not sending a written acknowledgement

Section 9 requires the IC to acknowledge receipt of a complaint within 7 days. Many ICs have never done this. One missing acknowledgement can unravel an entire inquiry in a tribunal.

Conducting joint hearings

Natural justice requires each party to be heard separately. Bringing the complainant and respondent together - even informally - can invalidate the entire process.

Accepting hearsay evidence

IC members must understand what constitutes admissible information in an inquiry. Hearsay that goes on record damages the credibility of the final report.

Not documenting the inquiry correctly

The IC's minutes, notes, and report must meet a specific standard. Reports that are vague, unstructured, or missing key findings are challenged and overturned.
